Usage rights
Understanding how you may use your photographs should not require a legal background. This page answers common questions about copyright, licensing, credit, sharing, editing, and permitted use of photographs created by Alma MN Photographer.
Your individual photography agreement remains the governing document for your project. Because usage rights may vary depending on the assignment, organization, campaign, or intended use, always refer to your contract for the specific rights granted to you.
FAQ
What are usage rights
Usage rights describe how a client has permission to use photographs after they are delivered.
When you hire a photographer, you are purchasing both a professional photography service and, depending on your agreement, permission to use the resulting photographs for specified purposes.
Usage rights may define where photographs can appear, how long they may be used, whether they may be used commercially, and whether they may be shared with another organization or business.
Do I own the photographs after I pay for photography services?
Unless a written agreement specifically states otherwise, no.
Alma MN Photographer retains the copyright to the photographs created. Your agreement grants you permission to use the photographs according to the usage rights outlined in your contract.
Paying for photography services does not automatically constitute a transfer or sale of copyright.
What is the difference between copyright and usage rights?
Copyright is ownership of the photograph itself.
Usage rights are permissions granted by the copyright holder that allow another person or organization to use that photograph in particular ways.
For example, an organization may have permission to use photographs on its website, social media accounts, newsletters, annual reports, or promotional materials while Alma MN Photographer continues to own the copyright.
Can I post the photographs on social media?
Yes, when social-media use is included in your photography agreement.

Photographs should be used in accordance with the terms of your license and should not be altered in ways that substantially change the original work.
Can I use the photographs on my website?
If website use is included within your agreement, yes. This still includes providing proper credit.
This generally allows the photographs to appear on the website belonging to the person, business, or organization that commissioned the work.
Permission to use photographs on your website does not automatically give another business, sponsor, partner, vendor, or organization permission to take those photographs and use them on its own website.
Can I give the photographs to another organization, sponsor, vendor, or business?
Not automatically.
Usage rights granted to one client are generally non-transferable unless your agreement specifically provides otherwise.
If another organization, sponsor, publication, vendor, business, collaborator, or other third party would like to use a photograph, please contact Alma MN Photographer before providing the high-resolution file.
In many circumstances, permission is simple to arrange. Asking first ensures that everyone understands how the photograph may be used and appropriately protects the photographer, client, and people represented in the work.
What if a vendor photographed at my event wants a copy of their photograph?
Please contact Alma MN Photographer or direct the vendor to do so.
Being photographed at an event does not necessarily grant a person or business independent usage rights to the resulting photograph.
When appropriate, separate permission can be provided for the vendor's intended use.
Can a publication or journalist use the photographs?
Potentially, but permission should be confirmed first unless your agreement already authorizes that use.
Editorial and press requests can often be accommodated. Please provide the publication with Alma MN Photographer's contact information so that image delivery, resolution, usage, and proper photographer credit can be coordinated directly.
Can I send the photographs to the media?
Please contact Alma MN Photographer before distributing files to outside publications unless press distribution is expressly included in your agreement.
This allows the appropriate files to be provided and ensures that the publication receives accurate photographer credit and usage information.
Can I edit the photographs?
Please do not substantially alter the photographs unless your agreement expressly permits it.
This includes applying filters, changing colors, using AI to modify the photograph, removing or adding elements, creating composites, or otherwise changing the appearance or meaning of the original work.
Photography is a completed creative work, and editing can affect both the integrity of the image and how the photographer's work is represented.
Can I crop a photograph?
Minor cropping necessary to accommodate a platform's standard dimensions may be acceptable when it does not materially alter the photograph or misrepresent its context.
More substantial alterations should be discussed with Alma MN Photographer first.
When possible, please use the photograph in its delivered composition.
Can I add text, graphics, stickers, logos, or other elements over a photograph?
Please ask before modifying a photograph with additional visual elements unless this use is specifically included in your agreement.
Placing graphics, stickers, filters, large text treatments, collages, or other visual elements over a photograph changes the presentation of the original work.
If you need an image formatted for a particular campaign or design, please reach out so we can determine the best approach.
Can I use AI to modify the photographs?
No, unless explicit written permission has been provided.
Photographs may not be uploaded to or processed through generative AI systems for the purpose of altering, recreating, extending, replacing, or generating elements of the original photograph without authorization.
This restriction helps preserve the integrity and authorship of the original work.
Can I make a collage using the photographs?
Please request permission first.
Combining photographs into a collage or substantially altering their presentation may constitute a modification of the original work.
If a collage or special layout is needed for a campaign, event recap, or other project, please contact Alma MN Photographer.
Can I use the photographs in advertisements?
Advertising and commercial usage may require different licensing from standard organizational, editorial, archival, or social-media use.
Before using photographs in paid advertising, sponsored campaigns, product promotion, packaging, billboards, paid social-media placements, or other commercial applications, review your agreement or contact Alma MN Photographer.
Can another company use my photographs to promote itself?
Not unless that company has permission.
Your license does not automatically extend to another company simply because that company appears in the photograph, participated in the event, sponsored the event, or works with your organization.
Third-party commercial use should be authorized separately.
What does "non-transferable" mean?
Non-transferable means that the usage rights granted to you belong to you or your organization and cannot automatically be passed to someone else.
For example, if Organization A commissions photography and receives permission to use the images, Organization A cannot automatically grant Organization B the same rights.
Organization B should request its own permission when necessary.
Why does photographer credit matter?
Credit identifies the person who created the work and helps preserve the authorship and history of a photograph.
This is especially important in documentary, cultural, community, nonprofit, and photojournalistic work, where photographs may continue circulating long after the original event.
Does giving credit mean anyone can use the photograph?
No.
Credit and permission are separate.
Crediting the photographer identifies the creator of the photograph, but attribution by itself does not grant permission to reproduce, publish, distribute, modify, or commercially use an image.
Can I download a photograph from social media and repost it?
A photograph being publicly visible online does not automatically make it free to use.
If your organization does not already have permission to use the photograph, please contact Alma MN Photographer before reposting, downloading, publishing, or otherwise using it.
